1. Definitions

In these Terms of Use ("Terms"):

1.1 "Service" means the website operated at elite-aircraft.net, including all catalog pages, aircraft listings, search tools, contact forms and related content.
1.2 "User", "you" or "your" means any individual or entity accessing or using the Service.
1.3 "Content" means all text, images, listings, specifications, pricing, descriptions and other material made available through the Service.
1.4 "Operator", "we", "us" or "our" means Elite Aircraft, the entity operating the Service at the contact address below.

2. Acceptance of Terms

By accessing or using the Service you agree to be bound by these Terms and by our Privacy Policy and Cookie Policy. If you do not agree, do not use the Service. You must be at least 18 years old to use the Service; the Service is directed at buyers, brokers and owners of aircraft and is not intended for minors.

3. Description of Service

The Service is an information and referral marketplace that publishes curated aircraft listings and related content. We do not hold title to the aircraft listed, are not a party to any transaction between buyers and sellers, and do not act as an escrow agent. All transactions are between the User and the relevant aircraft owner or authorized broker.

4. User Conduct & Prohibited Uses

4.1 Permitted Use

You may browse the Service, submit inquiries through the contact forms, and share links to listings for lawful, non-commercial purposes.

4.2 Prohibited Conduct

You agree not to:

scrape, mirror, frame or resell any Content without our prior written consent;
interfere with the Service's operation, security or availability;
misrepresent your identity, qualifications or intent to transact;
use the Service to distribute spam, malware or unlawful solicitations;
use automated systems that place unreasonable load on our infrastructure.

5. Intellectual Property

All Content on the Service — including site design, code, logos, photographs, and written descriptions — is owned by or licensed to the Operator and is protected by United States and international copyright, trademark and other intellectual-property laws. No Content may be copied, reproduced, republished or redistributed without our prior written consent, except for personal, non-commercial viewing.

6. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct we believe violates these Terms or is otherwise harmful to the Service or other Users. Upon termination, sections 5, 7, 8 and 10 survive. Personal data handling on termination is governed by the Privacy Policy.

7. Disclaimer of Warranties

7.1 THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

7.2 WHILE WE REVIEW LISTINGS BEFORE PUBLICATION, WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS OR CURRENTNESS OF ANY AIRCRAFT SPECIFICATION, HOURS, LOGBOOK, PRICE, LOCATION OR PEDIGREE INFORMATION. USERS MUST INDEPENDENTLY VERIFY ALL MATERIAL FACTS BEFORE ENTERING INTO ANY TRANSACTION.

7.3 WE MAKE NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR FREE OF ERRORS, VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

8.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE OPERATOR, ITS AFFILIATES, OFFICERS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL OR TRANSACTION OPPORTUNITY — ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8.2 OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO ONE HUNDRED UNITED STATES DOLLARS (US$100).

8.3 NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, WILFUL MISCONDUCT OR FRAUD.

9. Changes to Terms

We may update these Terms from time to time. The "Version" and "Last Updated" fields at the top of this page will reflect any change. Continued use of the Service after changes are published constitutes acceptance of the revised Terms. Material changes will be highlighted on the homepage for at least seven (7) days.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, United States of America, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in the County of San Francisco, California. You waive any objection to venue in those courts.

11. Severability & Contact
